Who has the right to claim them?
my nephew is married, but has kids from a previous relationship. he has always claimed them on his taxes, since their mother does not work. she has sole custody, but he pays child support on them, including medical benefits, he sees them every other weekend.She has a boyfriend whom she wants to claim them on his taxes. can they do that or is it my nephews right to claim them since he pays child support on all 3 of them.

There's not enough information to give you an exact answer, but here is an overview of the information I have.

Dad MIGHT be able to claim the child as a qualifying child under the special rule rule for divorced or separated parents. (must either be in the divorce decree or have a 8332 (or similar statement) filled out by mom) He wouldn't be able to use them to claim EIC, but would be able to claim child tax credit if this applies to his tax situation.

Dad would probably have a difficult time proving that he provide more than half the support to claim the child as a qualifying relative.

The boyfriend definately couldn't claim the child as a qualifying child, but MIGHT be able as a qualifying relative. Must meet the following tests..
Relationship/Member of household - he must live with them the ENTIRE year
Gross Income - child can't make more then the exemption amount ($3500 for 2008)
Support - he'd have to provide more than half the child's support
Not a Qualifying child - boyfriend couldn't claim the child if the child is a qualifying child of someone else i.e.his father, or since the mother didn't make any money, if any of the siblings made enough where they are required to fill out a tax return.

He won't be able to use the child to qualify for head of household (not related), can not claim the child for child tax credit, and can not claim the child for EIC.

Since boyfriend could only potentially claim exemption, and dad could potentially claim exemption plus child tax credit, if their income is similar and high enough where child tax credit makes a difference, dad would get the better break.

If the divorce decree doesn't give him the exemption he could also see if he could make a deal with their mother to see if he could claim one and the boyfriend could claim one if that would make their mother more likely to let him have some tax break from the children.

Unless the mother has signed Form 8332 or equivalent document waiving her right to the exemption to your nephew, your nephew cannot claim the children.

The boyfriend can claim the children (for an exemption only, no other benefits) if

1. The children lived with him all year
2. The children do not have income of $3,500 or more
3. The boyfriend provided over half of the childrens' support.

The amount of child support provided by your nephew has no bearing on whether he can claim the children.

Maybe nobody can.

Your nephew can't legally claim them unless he either has a valid court order saying he can, or has written permission from the mother. The fact that he pays support does not change this.

If the kids lived with the boyfriend ALL year, he provided over half of their support for the year, and the mom had income under $3500 for the year, the bf might be able to claim them, otherwise not.

Exactly what Ninagramma said. the mother must fill out form 8332 to allow the father to claim the child. Otherwise the boyfriend can claim the child because of the fact that they lived with the boyfriend all of the year.

well, if they aren't the boyfriends financial responsability and he is not and has not had any financial involvement with them then certainly not...the only way it would be ok is if he were living in the home and for the full year had been supporting them.

This one is fairly simple. It is outlined who can claim the kids for tax purposes in 99% of divorce decrees and child support orders. Look there first. I not addressed or not in you brothers favor then he will have to go back to court with or without an attorney.

You need to consult an attorney. There are ones who will see you for very little to no money. Look for Legal Aide in your area. It is composed of local attorneys who volunteer their time.

In general, the custodial parent usually has the right to claim the children, unless there's something else worked out in the divorce agreement.

I understand that your nephew is being great about keeping up with his child support, but whatever he's paying, it probably isn't enough to equal 50 percent of the cost of supporting them. Mom's boyfriend, like it or not, is probably just as financially responsible for them as their dad is.

I do believe that the only people that can claim the kids are the parents. If his x has a boyfriend to the best of my knowledge he cannot claim them unless they are married.
