Who should claim dependent on taxes?
My boyfriend and I live together and are expecting soon... Since we file individual taxes, who should claim the baby? The person with the higher or the person with the lower income?

If the baby comes before the end of the year, then have whoever makes the most money claim him/her. The tax law doesn't really take unmarried, but together, individual couples into account in any precise way, so they may question it. If they do, just explain the situation- I've had to do this for a client before, they understand.

But you can't claim the baby unless it's born during the year, so you've got 3 weeks.

A lot of people are answering that the person who makes the most income should. I guess those people don't know how the earned income credit works. Giving it to who makes the most may cost $1000s in earned income credit.

The only way to know for sure is to do both of your tax returns both ways and see which combination gets you guys back the most total refund.

the higher income will get more tax benefit from the deduction. Typically the mother should claim the child unless the father is prepared to prove that he provides over half of the child's living expenses.

You need to figure it both ways and then file the way that results in the lowest total tax liability, adjusted for any credits that you may be entitled to.

Traditional guidance says that the person with the higher income would get more benefit from claiming the child. That used to be true, but it's not that simple any more. The one with the higher income may make too much to qualify for the EIC or may qualify for less EIC than the one with the lower income. Another snag is which one of you can file as Head of Household. Only one of you can, and it has to be the one who paid more than half of the cost of maintaining your home. Since that has an affect on taxes too, you need to consider that as well.

You'd have to figure it both ways. It isn't always the higher income or the lower income person who gets more benefit.

Where will you be living?
Where will the baby be living?
Who has income?
Who is paying the bills?

All of these affect the tax returns the baby *can* be on as well as which tax return the baby should be on.

If both parents are eligible and can't agree, then the one with the higher AGI "wins" the tie-breaker.
