Who should claim my 4 month old daughter on 2007 tax return?
My boyfriend and I are living together and i am a stay at home mom. I worked for half of the year and then quit to be a stay at home mom and he works full time. We're not fighting over who should be able to because the money is going to pay off debt either way, but we're curious who would get more money by claiming her. he's made more money through the year, i'm not sure if that matters, but that's where we're at.

Any advice would be helpful. thanks

he claims her.

the law says that the person who provides over 1/2 her support claims her and receives the special child benefits.


besides, since he had more income, his tax bracket is likely higher than yours and thus the added exemption and Head of Household status will save him more in taxes.

If you are filing yourself, figure out both your totals with her as a deduction and then pick the ones that suits you best. If you are getting it done by someone, then ask their advice.

Without knowing what each of you made for the year, there's no way to tell - would have to figure it both ways. It isn't always the higher or lower paid person who gets the most back from claiming a child - EIC really can make a difference there. If you'll post again with what each of you made, someone can give you a better answer.

With the info you provided, anyone who said who should claim the baby is just guessing and might be wrong.

try it both ways IF he is the father. if he is not the father, then he cannot claim the child for eic

I assume this is his biological baby.

If so, generally it's best for him to claim the baby since he worked full time.

In reality, try the returns both ways. Whichever combo gives you the most money is the one you'd want. (If you can't agree, the person with the highest AGI "wins.")

Set 1.
He files HOH, claims baby, child tax credit and EIC.
You file single do not claim baby, do not claim EIC.

Set 2.
He files single, no baby, no EIC.
You file single with baby, child tax credit and EIC.

Let me stress since the baby is both of yours, whomever doesn't claim the baby isn't eligible for EIC. Period. The charts talk about filing without a qualifying child, but the baby is a qualifying child, just on someone else's return.

you would probably get a bigger refund putting her on boyfriends return so long as he gives you half of any refund related to your and hers tax exemption

I would say your boyfriend. He could claim head of household since he made more than half the income, and I believe you would file seperately as a single person since you did work, but the two of you are not married.
