If the 3 of you live together either of you can claim the child. Normally the one with the higher income will get the most beneift from claiming the child. He can file as Head of Household (actually irrelevant due to his very low income) and would normally qualify for EIC. The EIC would work out to $1,029 on $3,000 of earned income.

To add to the last answer, I would need to know who you lived with besides your boyfriend and child, and who supported you. I also need to know your ages and whether either you or your boyfriend are in school.

Your boyfriend earned less than $3,400. If a relative such as a parent, granparent, brother, sister (and a few other types of relative) supported him, then he is a dependent of that relative. He cannot claim a dependent himself or get EIC.

The above paragraph also applies to you.

Since your boyfriend earned so little, it is not possible that he provided over half of your support. He cannot claim you as a dependent.

Unless there is some other source of income supporting you or your boyfriend that allows you to be not a tax dependent of someone else, neither you nor your boyfriend would be able to claim your child, let alone yourselves, on your tax returns.

As to who may claim the child: If the child is living with another relative in addition to the parents, and the parents cannot claim the child (as described above), then it may be possible that the other relative, typically a grandparent, will claim the child. If this happens, plus your boyfriend tries to claim the child, the boyfriend will have to pay back the EIC plus penalties and interest.

So, discuss your situation with a local tax professional before you do anything.

I assume he is the biological father of the baby.

With an income of $3000 he isn't going to owe any income tax, and unless you made over $8750 in those 2 weeks you worked (possible I suppose, but not likely) you won't either, so you'll both get back anything you had deducted for federal income tax.

If you made under $3000, he'll be eligible for a higher EIC by claiming the baby than you would. His EIC amount will be a little over $1000.

One question though - how did you live on just over $3000? If either or both of you lived with a parent for over half the year, it's very likely that parent can claim you rather than claiming yourself. You don't say where you lived for the year. If one or both of you can be claimed by a parent, that person can't claim themselves OR the baby, or get EIC, whether their parent actually claims them or not, so my answer might change.

You should not take tax advice from strangers over the Net. You should have a tax specialist prepare the returns both ways and work out which give the better result.

A side note. Why on Earth would you bring a child into the world? If neither of you has a reliable income, you are really harming the child's future. Don't rely on the taxpayers all your life. Provide for yourselves.

If he made that little he will more than likely get back all of his.
