Do your taxes both ways and then select the one that has the most impact. If you use an online software such as Turbo Tax, you don't pay until you file.
It can go either way. Sometimes the additional dependents help the person with the highest income the most; other times, it can help the person with the lowest income to be eligible for the earned income tax credit.
I'm assuming from the way you asked your question, that your fiance is the other parent and that you live together. |

I assume the children are children of both you and your fiance and that you live with your children.
Either parent may claim the children. You may choose to claim the children in the manner that yields the greatest refund. Figure your taxes all possible ways as there is no general answer as to which parent will get the greatest refund.
If there is a dispute between you, the parent with the higher income has a priority claim on the dependency exemption. |

Whoever is spending more on their upkeep claims them. The kids would be that person's dependent since they are mostly dependent on them. |

If you and your fiance are not both parents of these children, then only the person who is a parent of these children should claim them.
If you and your fiance are both parents of these children and you and your fiance were not living together, then the parent with whom the children lived more than half the year should claim the children.
If you and your fiance are both parents of these children and you and your fiance lived together, then the parent who provided more than half of the children's support for the year should claim them.
In all cases, only one person has the option to claim the children. If that person decides not to do so, then the children cannot be claimed by anyone. No one is allowed to claim a child whom another person is allowed to claim, even if that other person decides not to do so. |

i think its better for the person that has less income..but thats just based on my personal experience from before me and my husband got married.....having less income means you are more likely to qualify for the earned income credit...but i think you should go to taxact.com and run it both ways and see. its weird. like back in 2005 we made about 30000 and only got 2000ish back...then this year we made 12000 and our refund is 6612....but we have one more dependent..so run it both ways thats your best bet |

The legal answer is the guardian who spent the most resources supporting them.
From a deduction standpoint, it is usually best to have the highest earner can benefit the most because of the progressive tax system. |

The previous post is wrong. If the child lived with both parents for more than 6 months, then the child is a qualifying child for both parents. The can decide between themselves who gets to claim the child (assuming they are not married to each other). Depending on how much earned income each parent earned, the only way to know for sure is to fill out each parent's return with each one claiming the child and not claiming the child, and seeing which combination yields a greater net total refund. If I knew how much income each person made, I could tell you exactly who should claim the child.
