Why are tax returns taken when you owe back child support in Texas?
My brother owes $30,000 in back child support in Texas and wants to know if the state taking his tax refund constitutes a payment (credit) towards his monthly payment or is this just a method to get him caught up. PLEASE explain in detail!!!!

The returns are taken to cover the arrears in his support. It will NOT be considered a credit towards any monthly payment due at the current time. He needs to keep making those.

No it does not relieve him of paying his full monthly payment, it just applies to the overall balance to help him get caught up.

They will keep taking his returns until he is caught up or they decide to put him in jail.

It is only applied to the child support that is in arrears. It does NOT count towards his required monthly payments. Child support payments that are currently due are not subject to capture of a tax refund; only those in arrears are.

it is so dead beat non custodial parents support their children like an adult should. in some states they may lose their license and go to jail. if the non custodial parent did the right thing in the first place there would be no need to seize tax returns etc. tell your brother to man up and take care of his child. my step daughters father has quit jobs to not pay support for them. he isn't a man nor a father, he's lied to them etc. the h-ll w/ him i support them and proudly.

It is just a way to get him caught up. they will take all of his returns until he is caught up and owes no back taxes.

The state must recoup the child support payments. The tax payments represent an easy and simple way to catch your brother up. Because this automatically credits his account it is a good thing. Back child support often creates many negative effects like warrants, tax liens, and bad credit references. Anything that catches your brother up is a good thing.

What detail do you need? They are taking his refunds because he refuses to pay what he is legally obligated to pay to raise the children he created.

No, the garnishment is not a payment - it is applied to what he owes from the past. So if he thinks that her getting his $300 stimulus rebate covers his May or June payment, he is wrong. It goes against the $30000 he owes and he still also his monthly payment.

I hope he gets caught up. How he stands up to the consequences of his actions is the best measure of what kind of a man somebody is.

When they take a tax refund, it is for BACK support. They are not allowed to take tax refunds for current support. According to federal law they can only take a federal tax refund if you are at least $500 AND 3 months worth behind, obviously your brother meets that criteria. It is considered a penalty for getting behind, & the cs office is ONLY allowed to apply it to a back support amount. If for example your brother only owed 2k in back support, and $500 for the current month which isn't paid yet, & he was getting a 3K refund, then the cs office would only be allowed to take the 2k from his tax refund. It is a method to get him caught up.
