Why did I get a refund if I still owe taxes?
I just got a letter stating I owe taxes from 2003...how come I have received a refund every year since then if I owed the IRS money? Why didn't my refund get put towards what I owe?
                     
 




Knowledge is good.
That sounds suspicious. Make sure that's not some kind of scam someone's pulling. Call the IRS to make sure it's legit.

The Underreporter Unit (the one telling you that you owe taxes) is a different department than the Refund Unit. The Underreporter Unit has to file paperwork with the Refund Unit to stop you from receiving any returns. That probably wasn't filed until recently (about the same time you received your letter.)

It probably should have, but sometimes the paperwork doesn't catch up with the refund.

Because they didn't figure out that you owed taxes until recently.

HOWEVER, it would be highly unusual for the IRS to come after you now for taxes due on your 2003 income as the statute of limitations for 2003 ran out last April unless you failed to file a return for 2003 or they suspect that fraud or significant understatement of income was involved on a return that you did file OR if you filed the 2003 return very late.

What exactly did the letter say and who was it from?

If you just got the letter means maybe it is from not filing a tax return for 2003 and IRS send you a "proposed individual tax assessment" giving you the chance to file the return or agree to how IRS will file and it takes month for IRS to file it for you, they wait for you to comply. Or if you underreported then they haven't assessed the amount yet that is why your refund was released.
So save your refund IRS will eventualy want their money and you will also be charge penalties and interest.

Oh for crying out loud, Plasma, it's not a scam! Jen T., basically, one hand didn't know what the other hand was doing. There are 2 different departments entirely. BUT, now that the 'collection department' has caught it, do not expect to receive any refund in the future until either: 1) the tax is paid in full or 2) if they will allow you to make some payment arrangements until it is PIF. It really depends on how much you owed. By the way, if you are married to a man that didn't file jointly with you in 2003 but does file jointly with you now, he can ask that his 1/2 of future refunds be exempt because he isn't responsible for the 2003 return. You would need to talk to a tax accountant about that to know how to go about it. Good luck!

it is reallly not fair for the IRS to go back 5 years and do this, check with a tax preparer and ask them if they can go back that far....I seem to recall that they can go back 10 years but check it out...the IRS can do what they want.....probably gave u too much of a refund or they are asking the wrong person...ask the IRS if they do have the right person, they don't bite..have them check your SS#'s and make sure they have the right person...or ask the tax preparer H & R block on line if they can do this!!
