Wife filed taxes with wrong filing status and received a refund already. We were together all of 2007.?
My wife and I seperated Jan 17th 2008. We didn't talk after that and she went ahead and filed taxes as HOH I think and took 2 of the 3 kids as dependents. She received a refund approx. $1300. We have since talked and I told her that we need to file jointly to lessen my taxes and she agreed. If I file seperately I will owe 9K, if we file jointly as it should be I will owe $29. What can we do to fix this mess?? Should I file the correct tax return and also include a 1040X for her and an explanation?

i believe the only status that cant be changed it MFS to MFJ...but your wife filed HOH. So I'm sure you can fix this because if you two were still married on the last day of 2007, then she is not allowed to use HOH. Her only options were MFJ or MFS.

Your wife is the one at fault. She ILLEGALLY filed as HOH.

If the two of you agree to file jointly, you take her first return and you amend it into a joint return. You do this by putting her tax return information in column A, you put the joint info in column C and then manually calculate column B (the amount to add or subtract to make the A column equal the C column). You put the refund she already received on line 19. You both sign and you submit the return. (This becomes the MFJ return. You do NOT file it again.)

If she does not agree, you file an MFS return, claim your eligible dependents (under the tiebreaker rules, the parent with the highest AGI wins if you both claim them). Then she files a 1040X to convert her tax return to MFS and presumably pay money back.

Folks, to file MFJ, they AMEND HER return. THEY DO NOT send in another MFJ return. It will mess things up because she has ALREADY FILED.

If you separated in 2008, she can not file as head of household. Period!

You (both of you) need to file married filing jointly or married filing separately. If you file a separate return, you will probably generate an audit of her HOH return. It will be better if you get together and amend her return to add you and the other child and change the filing status.

According to the information that you have provided, it was illegal for her to file as HOH. A person can legally file as HOH only if they were, at the end of the tax year (generally 12/31) either unmarried or "considered unmarried". She must now either
a) amend her return to file jointly with you (as MFJ), which is what you want.
b) amend her return to file as "married filing separately". If she elects to do this, you must also file as "married filing separately".
c) obtain an annulment in state court declaring that you were never legally married. If this occurs, you must each file as either single or HOH. (Neither or you would be able to file as married.)

You need to file 1040X for Federal and appropriate state form (if your state has state income tax).

The best way to handle it, to use the same method as she used for original filing. If it was Tax company (H&B, Libertytax, etc), you (both) should go to the same location, they will have all information on electronic file.
It is not big deal, but has to be handled by professional.

Do not attemp to do it on the paper by yourself.

You go ahead filing MFJ. At the same time your wife files 1040X with short note attached. She will have to return the refund she received already. Attach whatever amount figured out on your wife's 1040X.
