Dash R | Wife passed away and can't cash stimulus payment ? |
My wife passed away and the bank wont let me cash the stimulus payment.
I asked the bank to cash it and gave them a death certificate, but they refused and that the check has to be reissued to me.
Unfortunately, they (BOA) said the check would re-adjusted, because its for living people.
My counter-argument is that it was a joint check and a joint filing. I could of spent $0-684 of the joint stimulus and she could of spent $0-684, so it doesn't make any sense for them to re-adjust the stimulus, I mean, what about the people in the same situation that went for the direct-deposit option, the gov't isn't gonna come after them asking for the money back, is it?
(I dont believe anything that BOA says for a minute)
I also looked at Form 1310, but its for a return, not a stimulus check....am I wrong ? Can I use this form ?
I tried calling the stimulus hotline and kept hitting 0 for operator, but all i kept get was pre-recorded ads about checking it online and that all circuits are busy.. |

Yes, you are right in assuming that since this is a joint check and either party is entitled to the FULL amount.
You do not need to go through probate for this because it was filed jointly and anything owned jointly does not go through probate, it goes to the adjoining party, same thing with a house or a bank account when its joint.
I know your scared about the warning:
"The check does carry the warning :Forgery of endorsements on Treasury Checks is a Federal crime. Maximum penalty is a $10,000 fine and ten year imprisonment."
All you do is sign for her, it is not forgery if you have her power of attorney, especially in such a joint matter. |

You should have just written for deposit only on the endorsement line and deposited in your checking acct. Your mistake was trying to cash it. You need to send the check back, with a Death Certificate, to the IRS requesting a check be reissued in your name only. |

Any check can be cashed in teh persons account that it is made out to simply by writing for deposit only on the back instead of a signature. |

Write void in the endorsement area, send it and a letter back to the IRS (death certificate is useful). It will be reissued. As a surviving spouse, you do not need form 1310.
The rebate is for anyone who was eligible and alive during 2007 and 2008. Even someone who died 1/1/2007 could qualify...so the amount will NOT be adjusted. (Common myth and BOA is not the IRS.)
The only hassle is if you wait until after 10/15 to send the check back to the IRS. If it isn't reissued by 12/31/2008, you would be stuck with a 2nd chance worksheet on the 2008 tax return. For estates of individuals who died in 2007, it would be too late to get the money.
PS, the bank is the bottleneck. Some banks know their clients so well they will cash the check anyway and quietly overlook the fact that the wife is dead. (They know the IRS will reissue the entire check in the husband's name anyway because it was a joint return.) Other banks stick to the rules. They must see the payees, both IDs and simply will NOT cash the check if she's dead. |
