If it is child support, the rebate amount will be held and adjusted against child support.

If it is court ordered child support then you will get his $600.00 but if he has other kids you will only get a percentage.
If he also owes federal taxes you will NOT get it since SAm will get paid first

They should take it, I think that is enough in arrears. You may want to call friend of the court and give them a heads up to be sure they are on him, if he is not being garnished yet they may not know where he works or anything and he will sneak by. I know of some dead beat dads who job hop to avoid paying their child support.

It depends on your state, when he files, IF he files. But some states if he has more than one vehicle in his name they go after one of them to help pay back support. Get help from your local courts or look for groups in your area that assist non-collecting parents like yourself. In my case, he's paying but the courts have not. He pays over $80 a week and I get $47 one week, $12 the next, sometimes only a $6 check. Hell, it costs them more than that to send it to me.

It will NOT come out of his stimulus check.

I would assume you would get his tax refund if you already have some kind of palimony judgement against him. Can you garnish his pay checks?- if he's getting a rebate he must have a documented income that's taxable. Check with a lawyer...

If the child support office is aware of the arrears you will get it first. Child support and student loans are the only things they can withhold the tax for.
