Will i get in trouble for filing....?
If my boyfriend and i live in the same house hold can we get in trouble for both filing single? I have 2 children and i claim them but he will claim head of house hold.
Additional Details
We are not married. He bought a house and i've lived with him for 5 months now. I assumed because the house is under his name he would have to claim head of household. he makes 50k and me only 25k.
the youngest child is his.
Filing joint is not even an option to me. we are not married and if something were to happen from now until next yr and we end up not together it screws up my chances when i go file next year.

If you are not married, then you have to file as single. So, you won't get in trouble if you both file single, because it's the legal thing to do.

If these aren't his biological children, he CAN'T file HOH.
Even if these are his biological children, if you claim them, he still CAN'T file HOH.

Since you now state that ONE of the children is biologically his, IF he files his return claiming that child, then he meets the has-a-qualifying-dependent test for HOH. You can still file as single claiming the other child (if you are eligible for EIC, it would be for only the child claimed).

Are they *his* children? If not, he can't file as HOH. You would both file as single, or you could file as HOH if you provide over half the household's support.

If they are his, and he provides over half the support for the household, he can file HOH, and you would file as single.

You can't get in trouble for both filing as single, because you're always allowed to choose from the applicable filing statuses.

You both need to file single.

He can't claim HOH unless he has kids of his own (or unless those kids of yours are his). Or unless he adopted yours.

You should claim the children on your return as long as you're the custodial parent.

You're both single, right? So you both can (in fact, MUST) file as single.

How is he filing head of household if you're claiming both children? *That* is the part where he might get in trouble.

Why would you get in trouble for both filing as single? You both ARE single, I assume. If one of you is still married to someone else, then that person couldn't file as single. He can file as head of household if he claims the child who is his, otherwise he just files as single.

You cannot get in trouble for both filing single. He can only file head of household if he can prove that he provided more than 50% of the support for the household. He can file hoh and you file single. Both of you cannot file hoh.

Are you not single in the eyes of the government? You may not be under your states commonlaw laws. check it out peace
