he worked at demos while going to college in 2007. For a little while. Demos closed down and he never got his W2's and doesn't know anything about taxes. Therefore he didn't file any taxes for 07. Yes, he's required to file. Yes, he can get in trouble.
He should contact the IRS and let them know that he failed to file, that his employer has not provided a W-2 (and is gone). They will provide assistance and he will not get into much trouble (at worst, a small fine) if he approaches them. But if he ignores this, it will only get worse. |

If your bf was claimed as a dependent, he needs to file a tax return if his wages were more than $5,350. If he earned less, he doesn't need to file. However, if taxes were taken out of his pay, the only way to get it back is to file a tax return.
If he has no W2 but he has his pay stubs, or at least enough of the pay stubs to figure out what he earned and what was withheld, he can file a tax return using a substitute W2.
If he files he will not get in trouble. If he doesn't file, he may get some grief in the future. An unfiled return stays open forever, and you never know what that employer is going to claim your bf received in wages.

If he made under $5350 total for the year, and they took out social security and medicare, then he doesn't owe anything additional and was not required to file, so there's no penalty. |

He can go to the IRS and get a transcript of his W2 then file. As long as he does not owe money he has 3 years to claim a refund. |

Either the employer did or didn't send the w-2 information to social security.
If they did: get a copy of the w-2. The IRS will give a w-2 "printout" that he can file with.
If they didn't: he has to prepare a "substitute" w-2, with as close to the correct information that he can recreate with check stubs, etc.
Will he get in trouble? Depends on how much he owes
If he is due a refund, the IRS will "ignore/overlook" it, hoping he doesn't file for 3 years, then they get to keep the whole refund.
If is owes, the IRS (actually their computer) will determine if it is "worthwhile" to go after him for back taxes. If they do, he will receive a bill, plus penalty and interest.

His W-2 went to the Social Security Administration and they send the information on to the IRS, so he can run but he can't hide. Sooner or later the IRS will track him down.
Only he can get his W-2 information from the IRS unless he gives someone else a power of attorney.
If he fails to file, eventually the IRS will send a letter showing the W-2 information and demand the tax, penalty, and interest.
If he keeps ignoring it, he will be in serious trouble for tax evasion.
If he had too much withheld, he might even have a refund due.
If he was self supporting and/or made enough, his mother will be denied her claim for the exemption she took for him and will owe tax, penalty and interest. |
