My husband owes back child support. Our tax returns are usually garnished. Will the same thing happen to our economic stimulus check? If so is there a way for me to protect my portion of it?

Yes, it will be garnished but you can fill out innocent spouse papers to get your share. I think you can find the forms online

It's probably too late to file Injured Spouse but you can give it a try.

There is a form that you can file called the Injured Spouse form that can protect your share. How much time is needed for it to all take place I dont know. I'd say you are close to the wire though. Check with the irs website for a number to call.

A. It could be that the amount deposited into your bank account was what remained of your stimulus payment after it was reduced, or offset to collect back taxes or other debts such as a student loan or child support. If this is the case, you will receive a separate notice about two weeks after you receive your stimulus payment and notice.

Yes it will likely be garnished. To protect yourself you need to file the Form 8379 which I have added a link to the page you can print and file asap. I also added some additional info on the way the form is used. Good Luck!
