Withheld wages?
Due to my wages dept getting my pay wrong 2 years ago I owe then £100. They have made no attempt to take it back from me over this time. I thought they would agree an amount each week but seems they forgot. So I kept quiet. Now we all are due back pay for a totally different reason and this week my collegues all got their money with a pay slip. I didn't get mine so I can only assume they are keeping it. My question is shouldn't I get taxed on the money therefore receive a pay slip? shouldn't they give me the money then ask for it back? and also if they are keeping it shouldn't they write to tell me this? They are the Local Council here in UK not just a small company. Please if you could tell me what my rights are before I contact them

You should be notified that they are taking action to recover moneys owed. Ask your payroll department about it.

If they didn`t take the money back at an earlier date then i wouldn`t think they would do it now. They usually would do it in the same tax year (April-March).
It could be totally unrelated, you are right to assume you should get it all detailed on a pay slip anyway.
I think there is another hiccup, just contact them and ask them about your backpay.

I didn't think they could take anything from you without you agreeing to it first as it was their fault. Keeping quiet doesn't always pay off unfortunately. Ask your supervisor or wages department why you didn't get the same pay as everyone else, it may just have been an oversight.

Just play dumb and ask why you didnt get any money they may have just forgot you!
if money you owe them is then mentioned then you forgot all about it and can sort out the right way to deal with it!

it is against the law to make deductions from wages without recieving permission from you in the first place apart from tax and NI deductions of course. you are required also by law to recieve a payslip even if you have zero wages to come.
and yes you are correct if you have been overpaid they cannot just take the overpayment back because you have paid tax on the overpayment so therefore you are entitled to a refund of tax on the overpayment.
ie if they have paid you £100 over and you pay tax at a 40% rate then they can only deduct £60 from your wages to pay the overpayment back

No employer, local authority or other, are legally allowed to deduct money from you with out your prior consent. Even if it is money previously overpaid.They must have your written authority and it is up to you how the money is paid back eg instalments deducted from wage at a rate chosen by you

In law it is known as an unlawful deduction from wages and is remedied through the tribunal or county court if it is not resolved with the employer

If they have paid you incorrectly they can not take the money back in one go they have to agree a resonable figure with you. as for withholding your back pay they cant do that either. I would contact the CAB or even ACAS, in fact ACAS would be better that will frighten them more, find out your real rights and then quote them to who does your payroll
