No. Believe it or not the IRS already has case presidence on this because it was tried before. The attorney for the tax payer took it all the way to the full board but lost. So you aren't the first person to think of this. :) |

If he's born in 2009, you claim him on your 2009 taxes (the ones you file at the beginning of 2010).
If he happens to be born early, you can claim him on your 2008 taxes as long as he's born on or before December 31. |
