Would being in a higher tax bracket or a certain income, prevent you from claiming a 17 yr. old as a dependent
My exhusband usually claims our son on his taxes. This year his tax consultant told him he couldn't claim him as a dependent, because he is 17 1/2. I looked at the IRS website and I found out the maximum age is 19 or 24 if fulltime college student. Would it make a difference if my ex was in a higher tax bracket or possible income increase that would not allow him to claim our son?

your son can be 45 and still be a dependent. He wont be a dependent child, but will be a dependent relative. but there are specific rules for this. go to irs.gov for the details.

At 17-1/2 nobody can take the child tax credit for your son, that stops when the child turns 17, but an eligible person can still claim him as a dependent and take an exemption for him. Perhaps your ex misunderstood what the tax person said - if not, he needs a new tax consultant - unfortunately, there are some poorly trained, incompetent people out there preparing taxes.

The right to claim any exemptions starts to phase out when income reaches $117,300. The age of the dependent is irrelevant.

him until hes 24, claiming him might not
give him more money, it will just lower
his taxable income since its 3,400 for
every dependent on return thats 3,400
less he has to report. Thus lowring his
tax owed, giving him more opportunjity
to get his full Federal Income Tax

If your ex makes a higher income he should definitely continue to claim him. Get the most from the IRS as possible.

No, the income level would not be the deciding factor. Your son can be claimed as a dependent as long as your husband is providing more than half of his support, or if it was written into your divorce decree that he could claim him on his tax return.

Even with a super high income, the dependency exemptions don't even phase out completely anymore.

As others state, it's the child tax credit only that's at issue.

What did the tax accountant say? He should be the one explaining it to you. That doesn't make any sense to me. You are correct - the age is 19, not 17 1/2.
