Kinder | Would it be illegal for me to claim head of household on my income tax? |
I worked and supported my children by myself untill I got married in August. We were going to file jointly but we will get more money (an additional $4,000.00 because of the earned income credit) if we both file seperatly. Would it be illegal? It's illegal for you to file as head of household when you are married and living with your spouse. It would be legal to file a joint return, or to file as married filing separately - if you file as MFS you aren't eligible for EIC
Your status as of the end of the year is what counts, and you were married by then. |

Congratulations you are married. You now get to file MFJ or MFS. If your combined income is too high for EIC, so be it.
You cannot file HOH. If you do and get caught claiming EIC, you will be BANNED from claiming EIC for the next 10 years. And this is a question of WHEN you get caught, not if. |

No, the rule is - if you are married, you must file "Married Filing Jointly/Separately", unless you are "unmarried for tax purposes." This is defined by:
1. Not living together for at least the last 6 months of the year
2. You must have a dependent child which makes you eligible for HOH
Therefore, you lived together August - December, strike 1. Strike 2, he would be "STUCK" with MFS and it would hurt him. The only legal option here is MFJ or MFS, and you will have a better return with MFJ most likely. |

Yes, it would be illegal. That's why they call it the "marriage penalty" (although it is not as bad as it used to be). Tax laws were written years ago when the "normal" situation for a married couple was to have the husband working and the wife staying home as a domestic slave. Although there have been some changes, you still pay more most of the time if both of you work. |

Yes; your status should be "married filing separately" if you are currently married but are not filing together. Of course, you wouldn't get as much back for married filing separately than simply filling a joint return. |
