The IRS won't tell you anything. All you can do is file your next return in a timely manner and see if it gets accepted by the IRS. If it bounces, you'll know someone else has claimed him.

Try to get yours done as early as possible so that yours will be the first one in, and the fraudulent one will bounce.

If you plan to have your return prepared, you MUST have a way to pay the preparer up front.

The IRS won't tell you anything. What someone else puts on their tax return is their business.

If in fact someone out there tries to use your son's social security number to claim him as a dependent then you're efile will be rejected, but you should still file by paper. Don't give up the deductions and credits that YOU are legally entitled to just because someone else has already claimed them illegally.

Here's a few pieces of advice:

File early. The first person to e-file will get their return accepted and processed quickly. Anyone who tries to claim the duplicated SSN later will have to mail paper forms and wait for an investigation to go through before getting their refund. Contrary to a popular myth, filling first doesn't mean you win the dispute, it just means you get your money before the dispute happens rather than having to wait until after the dispute is settled.

When the IRS sees the duplication they'll contact both parties and ask for proof of the claim. Find out what proof you need, and have it ready.

You'll never find out what happens to the other person. Their fraudulent tax return is between them and the IRS. However you can rest assured that the IRS is cracking down hard on tax cheats and the other person will regret their illegal claims.

All that being said, you can't really ever find out if someone else claimed your son. You simply file your own tax return and accurately claim everything you are entitled to claim. IF and when there is a discrepancy, be prepared to prove that what you claimed is accurate.

The IRS won't tell you anything. But if he lives with you, file your own return and claim him. If anyone else also claimed him, the IRS will notify both of you and ask you to prove that you have the right to claim him, then they'll deal with the person who claimed him illegally.

what is past is past and there is not a lot you can do about it
if your son is now your dependent(more than 184 'nites' with you) when you file your return for the year and it is rejected because someone else has used it then you protest that rejection and insist IRS have the other party prove their eligibility to claim the child
