well this is the problem my boyfriend was fired from work because of misconduct of an accident that happen but the general manager told him that wouldn't show on his record that he would be shown as voluntary leave something like that well he apply to unemployment which some people can be accepted even if they voluntary leave so he didn't really know what to put on the claim so he put laid off and they dont really ask you why so whatever the benefits were approved and he received money for a week . so now they sent him a letter saying that he has to pay the money back because he was fired for misconduct but he called a few days ago and they talked to them and they said there was no problem and since he got another job he ddoesn'tneed the benefits anymore but this letter came today saying he has to pay them back so my question is does he have to pay them back because we are kinda tight on the money and besides they actually take a week to investigate so why ddidn'tthey just denied the benefits then. |

Yes, he has to repay them. And the reason why they did not deny them earlier is that they did not know that he was not telling the truth when he said he was laid off and not fired for misconduct. |

If he lied on his application and the employer told the UC people why he was fired, then he has to pay back what he got since he shouldn't have gotten it.
It's rare that someone who leaves voluntarily is eligible for unemployment - there are only a few situations where than happens. |

apparently the employee did respond differently than he originally told your b/f
and yes, if he was not entitled to the benefits, they have to be repaid
in the urgency to get some money into hands of people just out of work without anything to eat, they don't take the time it really requires to find out if the person is eligible or not, simply basing the award on the word of the applicant |
